Clients should ensure they understand and accept the terms and conditions as set out below. Bookers are responsible for making Clients aware of these Terms and Conditions.
“Booker” means the guest who has paid for the retreat stay at the Workhouse.
“Client” means a Booker, a guest that the Client has booked on behalf of (for example someone who is sharing a double occupancy room with the Client or someone who is sharing a cottage with the Client where the Client has booked the entire cottage).
“We” means Hemingford Park Limited, the company offering the Workhouse retreat course.
“Activities” means the physical exercises contained in the example Itinerary shown on this website plus any others that are similar in nature, which may be substituted or added from time to time.
MEDICAL & HEALTH
Any form of physical exercise carries health risks and the Activities at the Workhouse are designed to be strenuous and difficult, which means that these health risks are higher when taking part in the Activities than those that exist at, for example, a gym. By taking part in the Workhouse Activities, Clients acknowledge and accept these risks.
As Clients of the Workhouse you will receive meals, snacks and drinks during your stay. You must inform us at the time of booking of any dietary requirements of any Client you are booking on behalf of. It is extremely important that you make us aware of any food or other allergies that any Client has, since we cannot be held responsible for the illness of a Client due to any allergy we were unaware of. If we cannot accommodate the dietary requirements of a Client we will inform the Booker before the start of the course and either cancel the booking with a full refund or discuss alternative proposals.
Our mentors can and will (within reason) adjust the difficulty levels of certain Activities to accommodate the fitness levels of Clients. Nevertheless Clients should expect to experience, at some point during their stay, sore and aching muscles, muscle strains, weakness and physical exhaustion. Clients may suffer injury from participating in the Activities and we are not responsible for those injuries Clients sustain other than as a result of our gross negligence.
Clients may elect, at their sole discretion, not to take part in any or all of the Activities. No financial compensation or refund will be available to any Client or Booker as a result of such a decision.
Upon arrival at the Workhouse all Clients will be required to complete a health questionnaire before participating in any of the Activities.
All Clients warrant and represent upon their arrival, and throughout their stay at the Workhouse, that they are in good physical condition and know of no medical or other reason why they should not engage in any form of exercise, and that such exercise would not be detrimental to their health, safety, comfort or physical condition.
The Workhouse staff are not medically trained and are therefore not qualified to assess whether the Client is in appropriate physical condition to take part in any of the Activities. Mentors can provide basic first aid (to treat minor cuts and abrasions) but they cannot provide more sophisticated medical aid and the Workhouse cannot dispense any medicines to Clients.
We advise all Clients to take medical advice prior to arriving at the Workhouse if they are in any doubt about their ability to exercise or take part in any of the Activities.
If Clients have any relevant medical conditions then they must disclose these to the Workhouse before arrival, stating whether either (a) they have sought medical advice and that this advice allows them to participate (we may ask for a letter from your Doctor confirming this), or (b) that they have not sought medical advice and nevertheless wish to take part in the Activities without doing so, and that they take full responsibility for any injury or health condition sustained, whilst taking part in any Activities, arising from their medical condition.
We will, at our sole discretion, forbid a Client from taking part in some or all of the Activities if we believe, in our reasonable view, that any might suffer illness or injury as a consequence. No financial compensation or refund will be available to any Client or Booker as a result of our decision.
Clients are required to use the safety features of any equipment. If Clients or Sharers are unsure how to use a machine, they are required to obtain instructions from the Workhouse mentors.
Travel Insurance with comprehensive Personal accident and cancellation insurance is highly recommended in case of injury or inability to complete the duration of your stay in the Workhouse.
To place a booking, the Workhouse requires a completed booking form with full payment and by placing a booking the Booker accepts these Terms and Conditions.
The Workhouse reserves the right to decline any booking at their sole discretion for any reason whatsoever. If such a booking is declined, we will return the Booker a full refund.
Unless otherwise agreed prior to booking, arrivals for the midweek course should arrive at between 6pm and 8pm on the Monday and depart no later than 9pm on Thursday. Arrivals for the weekend course should arrive at between 6pm and 8pm on the Friday and depart no later than 9pm on Sunday.
Clients who cannot arrive on the Monday of the course need prior agreement with the Workhouse.
Changes to bookings are all subject to availability.
FEE AND PAYMENT TERMS
The balance of the fee is payable in full on booking the course.
Where a Booker wishes to change their booking dates or names of Clients then the Booker must request this in writing at least 60 days prior to the start date of their original booking.
A booking (date or name) can be changed, subject to availability, without incurring an administration fee but may incur additional costs if the fees for the new dates are higher than for the original ones.
CANCELLATION BY THE WORKHOUSE
We try our best not to cancel a confirmed booking but reserve the right to do so for any reason.
If we cancel a confirmed booking before your attendance at the Workhouse we will offer the Booker the choice of either a full refund or other available dates (at no extra charge), at the discretion of the Booker.
CANCELLATION BY THE BOOKER
Should a Booker or a Client develop a medical condition, between the time of booking and the beginning of the course, and is no longer able to attend the course, we will require receipt of a Doctor’s note before we amend or change the booking but this will be done free of charge (subject to date availability).
If the Booker wishes to cancel the Contract they must advise the Workhouse in writing (a Cancellation Notice).
If we receive a Cancellation Notice earlier than 60 days prior to the beginning of the booked stay, we will give the Booker a full refund.
If we receive a Cancellation Notice later than 60 days but earlier than 30 days prior to the beginning of the booked stay, we will give the Booker a 50% refund.
If we receive a Cancellation Notice later than 30 days prior to the beginning of the booked stay, no refund will be given to the Booker.
RESPONSIBILITIES OF THE CLIENT
Bookers shall be held responsible to make compensation for any damage caused by them (and their guests) to the contents and furnishings of the premises during their stay, except for wear and tear.
The Workhouse accepts no responsibility for the loss, damage or theft of personal possessions, which includes, but is not limited to, clothing passed to third party cleaners, clothing, jewellery or similar items of value, personal equipment or the like, used on the course. All guests are advised to ensure that they are adequately insured against these events and not to bring valuables to the Workhouse.
It is the responsibility of the Client to arrange travel to the site / location for the proposed Activities and/or service(s) unless otherwise stated.
The Client is also responsible for their personal medical requirements and personal footwear equipment and clothing unless otherwise stated.
ALTERATIONS BY THE WORKHOUSE
We make every effort to ensure the accuracy of our literature. However changes can occur despite our best endeavours and we reserve the right to change any price or other particulars in this website from time to time.
If there is a ‘Major Change’ to a confirmed booking we will inform the Client as soon as is reasonably practical and offer you the choice of accepting the change receiving a full refund or transferring to another available date.
If there is any change other than a ‘Major Change’ we are not obliged to inform you in advance (but we will do so where practicable) nor are we obliged to pay you compensation. If we become unable to provide a major proportion of the services you have booked with the Workhouse we will make every effort to arrange alternative arrangements for you at no extra charge and where appropriate refund the Client pro rata for services not received. If the client wishes to make major changes to agreed programme additional costs may be added at our discretion.
The programmes we publish in our literature and on our website and describing the courses are designed to be illustrative in order to best explain the scope and type of activities you will be undertaking. It is very unlikely that any one programme could be or would be followed precisely as it is published. Several factors outside of our control will determine this and dictate what can be accomplished reasonably during your course. The most influential factors will be the weather the conditions physical fitness of course participants.
Taking these factors into consideration and the aims of the course as described in our literature, we will construct the best programme possible. We will review and may alter the programme as the course progresses in response to the changing influence of these factors.
CONDITIONS OF SERVICE
As part of the continual review of safety and associated considerations, the conditions of booking are subject to change clarification and modification at any time. Only a Director of Hemingford Park Limited is empowered to vary or waive any of these Terms and Conditions.
The Workhouse reserves the right to alter the content of the Services at any time without notice to the Client due to certain factors including but not limited to the weather and physical fitness of the client.
Our mentoring staff will do their utmost to ensure that any problems are solved for the benefit of the course participants as a whole. Signing the booking form signifies your acceptance of the mentor’s authority to make decisions affecting the group or individuals.
ACCEPTANCE OF AUTHORITY
Employees and staff of the Workhouse will use their best endeavours to resolve problems to the benefit of the Client as a whole.
The Client must refrain from any conduct that may give offence or cause danger or damage to any person or property.
If The Workhouse or any of its suppliers believe that the Client is in breach of this obligation likely to breach it or is otherwise unfit to partake in the activity we may, in our absolute discretion, refuse the booking or have the Client removed from any property or facility. The Workhouse will owe the Client no liability in such circumstances and the Client will be solely responsible for any costs incurred.
We may require an individual or number of persons to leave the group if they believe that any Client’s health and safety are at risk, if an illegal act has been committed or the Client has behaved in a way as to endanger safety enjoyment or the welfare of the group as a whole. In the event of this action the Client involved shall not be entitled to any refund from the workhouse and will be required to meet all expenses involved in their immediate extraction.
If there is a problem during the activity and or service period you must report it to in the first instance the instructor of your activity. If it is still unresolved you must then report it a Director of the Workhouse immediately so that prompt and effective efforts can be made to resolve the problem.
In the unlikely event that the problem cannot be resolved at this time and you wish to raise a complaint full written details must be sent to the Workhouse within 28 days of the activity and or service finishing. Please include your booking reference number / party details and exact full details of your complaint on your letter; please include your daytime and evening contact telephone numbers. Failure to take these steps will prejudice our ability to resolve your problem and/or investigate it fully therefore any right to compensation you may otherwise have had will be lost or substantially reduced.
The Workhouse reserve the right to take any recordings of the Client during the activity and /or services and the Client accepts that all rights whatsoever arising in the recordings shall by solely owned by The Workhouse.
The Client accepts and agrees that any recordings may be used by the Workhouse at its absolute discretion in any manner including but not limited to its website, socials media, marketing, PR, promotional material and advertisements.
The Workhouse reserves all copyright which may subsist in the products of, or in connection with, the provision of all activities, services or facilities.
The Workhouse reserves the right to take such actions as may be appropriate to restrain or prevent infringement of such copyright.
LAW AND JURISDICTION
This agreement shall be construed in accordance with the laws of England and Wales the Courts of England and Wales shall have exclusive jurisdiction in relation to any matters arising out of this Agreement.
